Labor & Employment

Bryant & Brown represents public, private and nonprofit employers in complex legal situations involving the workplace.

Over the past 15 years, the Oakland firm has negotiated more than 30 certificated and classified collective bargaining agreements. For example, Bryant & Brown has been the labor counsel and chief negotiator for Rosemead School District (Los Angeles County) since 1998, conducting successful negotiations with both certificated and classified bargaining units.

Since 2005, Bryant & Brown has acted as primary labor counsel for the Alameda County Community Food Bank, a major nonprofit organization providing services for the Bay Area’s poor. The firm has a wealth of experience dealing with the complex labor and employment issues of nonprofit organizations.

Our firm specializes in:

* Administrative hearings: A bitter termination proceeding or a dicey discrimination dispute can lead to a lengthy and costly trial. Often, the firm represents management against unions in such cases. But Bryant & Brown also can guide employers through alternative dispute resolutions.

The firm has acted as lead counsel in classified layoff situations and has conducted layoff hearings before the California Office of Administrative Hearings. The firm has represented school districts before arbitrators on numerous occasions and responded to well over 100 grievances. It has negotiated the effects of layoffs, including alternative layoff procedures.

Bryant & Brown has particular knowledge with regard to public employees in educational institutions. The firm is under contract with the University of California, Berkeley and the University of California, San Francisco Medical Center with regard to personnel and disciplinary matters.

* Employment discrimination: Bryant & Brown represents employers and housing agencies in discrimination complaints involving race, gender and disability. Whether Fair Employment or Housing Act claims, we help resolve issues quickly and efficiently.

The firm has represented school districts before the Public Employer Relations Board (PERB) on numerous occasions and has received published opinions in administrative and civil courts.

* Collective bargaining: Bryant & Brown has served as labor counsel and chief negotiator for school districts across California in numerous collective bargaining sessions.

We have extensive experience analyzing union proposals and preparing school district proposals in line with the core values and goals of the school district. We make sure management’s offer is clearly expressed to employees. Most importantly, we get contracts ratified.

After contract ratification, the firm has helped clients through the fact-finding process and has provided legal representation to the school board when the employees went on strike.

* Personnel manuals/training: A personnel manual spells out company rules and regulations for employees. If the manual is not clear and concise, a company could face lawsuits or employee confusion.

Bryant & Brown has drafted and reviewed hundreds of manuals over the decades. The firm takes it a step further by conducting personnel training to reinforce your company’s rules and regulations.
