Construction Law

Bryant and Brown, has experienced attorneys practicing in the area of public entity representation, including construction dispute resolution, public contracting and procurement, civil litigation and employment and labor law. The principals of Bryant and Brown Law Office have 17 years of experience practicing law in California, including years of practice in major San Francisco law firms representing public entity clients.

Meredith Brown, a principal attorney, has developed construction general conditions and special provisions for multi-million dollar public construction projects and provided claims avoidance counseling and defense for large capital programs involving multiple complex construction and joint development projects. Ms. Brown's principal areas of specialty are construction law, construction dispute resolution, public procurement, CEQA, civil litigation and real estate law for California public entities.

Scope of Services

1. Litigation Services

Mr. Bryant and Ms. Brown are seasoned litigators and have pending cases both in Federal and State courts. Mr. Bryant and Ms. Brown have participated in several trials and administrative proceedings, briefed and argued several cases in state superior court, state and federal appellate courts and Mr. Bryant has briefed matters before the California Supreme Court. Ms. Brown has successfully mediated multiple construction disputes and defended bid protests on multimillion dollar construction contracts.

2. Construction Contracts and Transactional Law

Ms. Brown has drafted construction general conditions and construction special provisions for multi-million dollar construction projects and provided claims avoidance advice and support for public entity clients conducting large capital programs involving multiple complex construction issues and joint use agreements. Ms. Brown lhs also drafted real estate templates, procedures, policies and forms for public entities including, but not limited to ground leases, joint use agreements, construction contracts, professional service contracts and, requests for proposals for school districts and private clients. Ms. Brown recently provided legal counsel to a public entity on a multi million dollar real estate transaction and managed a team of real estate, public finance and land use experts as part of this process.

Ms. Brown has drafted Bid Protest procedures which are utilized to analyze and resolve construction bid protests. Ms. Brown has drafted procedures and trained public entity staff on the competitive selection process including the use of Requests for Proposals; drafted contract templates; and drafted and negotiated and memoranda of understanding between various public and private entities.

3. Contract Administration Services

Ms. Brown drafted a public entity Procurement Manual that has over the past five years been evaluated, scrutinized and subsequently approved by FCMAT as a positive cost saving device to assist the school district in maintaining year to year fiscal responsibility. As a result of the procurement procedures and the expedited procurement process in place, hundreds of contracts receive legal analysis and review at substantial cost savings to the public entity.

4. California Environmental Quality Act ("CEQA")

Ms. Brown has extensive experience working with CEQA issues with regard to construction projects for lead agencies required to implement the CEQA environmental review process. Ms. Brown has been at the forefront of soliciting public comment on proposed public projects and proposed mitigation measures. Bryant & Brown is very comfortable with providing CEQA compliance advice to public entities.

5. Miscellaneous Services

Bryant & Brown has vast experience representing public boards and administrators with regard to the many complex issues facing public entities. Bryant & Brown maintains expertise with regard to the California Public Records Act, the California Government Claims Act, and other laws affecting how business must be conducted by public entities for the benefit of the community.
